("Bloom" or "Operator")

1. Scope and Subject Matter

1.1 Bloom offers an online mediation service for dinner experiences ("Dinner Events") via its website https://bloomhosts.com (the "Platform"). The core functionality is matching hosts ("Hosts") and guests ("Guests").

1.2 These Terms of Use govern the use of the Platform and the mediation services provided by Bloom.

1.3 By submitting the onboarding form on the Platform, the user ("Customer" or "User") agrees to these Terms of Use.

1.4 The User must be at least 18 years of age to use the Platform and participate in Dinner Events.

2. Conclusion of Agreement

2.1 The use of the Bloom service requires the conclusion of an agreement between Bloom and the User.

2.2 By filling out and submitting the onboarding form ("Join/Submit"), the User submits a binding offer to be included in Bloom's matching pool.

2.3 The agreement is concluded when Bloom confirms receipt or contacts the User for potential matching.

3. Scope of Services

3.1 Bloom provides a platform to match Guests with Hosts for Dinner Events. The matching process is currently performed manually by Bloom based on the data provided by Users.

3.2 Intermediary Role: Bloom acts solely as an intermediary. Bloom organizes the matching but does not organize the Dinner Events themselves. The contract regarding the participation in a Dinner Event is concluded solely between the Host and the Guest. Bloom is not a party to the Dinner Event contract.

3.3 No Guarantee: Bloom does not guarantee the successful matching of Users or the actual occurrence of Dinner Events.

3.4 Modifications: Bloom reserves the right to modify, suspend, or discontinue the Service at any time.

4. User Obligations & Code of Conduct

4.1 Users agree to provide truthful and complete information during the onboarding process.

4.2 Code of Conduct: Users must treat each other with respect. Harassment, discrimination, or offensive behavior will not be tolerated and may lead to exclusion from the Platform.

4.3 Responsibility:

• Hosts: Hosts are responsible for the safety and hygiene of the food and environment provided.
• Guests: Guests are responsible for disclosing any relevant preferences or needs to the Host.

4.4 Contact: By submitting the form, the User agrees that Bloom may contact them via the provided phone number or email for matching purposes.

5. Fees

5.1 The use of the Platform for matching purposes is currently free of charge.

5.2 Any costs for Dinner Events (e.g., contribution to expenses) are settled directly between Host and Guest if applicable. Bloom does not process payments.

6. Liability & Disclaimer

6.1 Platform Liability: Bloom is liable to the User without limitation in the event of intent, gross negligence, and culpable injury to life, body, or health.

6.2 Negligence: In cases of slight negligence, Bloom is only liable for the breach of material contractual obligations, limited to the foreseeable damage.

6.3 Event Disclaimer: Bloom assumes no liability for the execution, quality, or safety of the Dinner Events. Bloom is not liable for damages, injuries, food poisoning, accidents, or disputes arising between Hosts and Guests during or in connection with a Dinner Event. The Dinner Events are private meetings facilitated by Bloom. Participation is at the User's own risk.

6.4 User Disputes: Bloom is not obliged to mediate disputes between Users.

7. Data Protection

7.1 Personal data is processed in accordance with our Privacy Policy. Bloom uses the data provided in the onboarding form primarily for the purpose of matching Hosts and Guests.

8. Term and Termination

8.1 The user relationship runs for an indefinite period.

8.2 Either party may terminate the relationship at any time. Users may request the deletion of their data to terminate the relationship.

8.3 Bloom reserves the right to block or delete Users who violate these Terms of Use.

9. Cancellation Policy

Note: Statutory right of withdrawal for consumers in Germany.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us (Bloom, Banas & Muhuri GbR, Thorwaldsenstraße 9, 80335 München, data@bloomhosts.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).

Consequences of Withdrawal

If you withdraw from this contract, your data will be deleted and you will be removed from the matching pool.

10. Final Provisions

10.1 German law shall apply.

10.2 The exclusive place of jurisdiction for all disputes is Munich, Germany.

10.3 Should a provision of these Terms of Use be or become invalid, the legal validity of the remaining provisions shall remain unaffected.

10.4 The Operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
